Terms of Service

This document is a general template provided for convenience — it is not legal advice. Zabota Nails recommends having it reviewed by a qualified attorney before relying on it.
About these terms
These Terms of Service ("Terms") govern your use of the Zabota Nails website and the nail-care services provided by Zabota Nails, an independent nail artist based in New York City, including appointments booked online. By booking an appointment, using the site, or receiving a service, you agree to these Terms. If you do not agree, please do not book or use the service.
The service and your results
Services are performed with professional skill and care, but they are provided on an "as is" basis. Every person’s nails, skin, and lifestyle are different, so individual results — including the appearance, fit, and how long a manicure, enhancement, or design lasts — will vary from client to client. We do not guarantee any specific outcome, or that a result will last for a particular length of time.
Health, allergies, and disclosures
Your safety matters. Before your service begins, you must tell us about anything that could affect it — including allergies or sensitivities (for example to acrylics, gels, adhesives, or latex), skin or nail conditions, infections, cuts or injuries, recent surgery, medical conditions, medications, or pregnancy. We may adjust, postpone, or decline a service based on what you share. We are not responsible for reactions, irritation, or complications that arise from conditions you did not disclose, or from a failure to follow the aftercare guidance we provide.
Aftercare
The longevity and condition of your nails after your appointment depend partly on how you care for them. You are responsible for following any aftercare instructions we give. If you notice a problem — such as lifting, breakage, or irritation — contact us promptly so we can advise or, where appropriate, arrange a fix.
Booking and deposits
Appointments can be requested through the online booking on this site. Some services require a deposit to reserve your time slot. Any deposit is applied toward the total price of your service, with the balance due at your appointment. Deposits and payments are processed securely through Stripe (see our Privacy Policy).
Cancellations, rescheduling, and no-shows
Because your appointment time is reserved just for you, please cancel or reschedule at least 48 hours before your appointment. If you cancel or reschedule with less than 48 hours’ notice, or do not show up, your deposit is non-refundable. For a no-show we may also charge a no-show fee of up to 50% of the booked service price; any deposit we keep counts toward that fee, so the fee never exceeds 50% in total. If you agreed to keep a card on file (see “Saved cards” below), the fee may be charged to that card; otherwise we will send you a payment link or settle it at your next visit. Arriving late may mean your service has to be shortened. (The studio may set or change the notice period and the fee percentage; the current values are 48 hours and 50%.)
Right to refuse or stop a service
We may refuse to begin, or choose to stop, a service at our reasonable discretion — for example if you have a contagious infection or a condition that is unsafe to work on, if you are under the influence of alcohol or drugs, if behavior is unsafe, abusive, or inappropriate, or if payment is not made. We apply this fairly and do not discriminate on any basis protected by law.
Photography and portfolio use
We may photograph or film completed work for our portfolio, website, and social media. These images usually show hands and nails only and are not intended to identify you personally. If you would prefer that photos of your work not be used, just let us know before or at your appointment and we will respect that.
Prices, payments, and taxes
Prices are shown before you confirm a booking and may change over time. Applicable sales tax is added where required. Payments and deposits are handled by Stripe; we never receive or store your full card details.
Saved cards, paying your balance, and text messages
Saved cards: you choose. When you book, you may tick “keep my card on file”. If you tick it — whether or not the service takes a deposit — Stripe stores the card and we may use it for (a) the no-show fee described above and (b) the remaining balance of a visit you have received, in each case for the amount shown on your booking. If you don’t tick it, no card is kept. We never see or store your full card number, and you can remove a saved card yourself at any time from the link in your confirmation email, or by asking us.
Your balance: the part of the price not covered by your deposit is due at your visit. You can pay it in the studio, or we may send you a secure Stripe payment link by email or text message; a link is valid for 24 hours. If a balance is paid twice by mistake (for example by a link after it was already settled in the studio), the duplicate payment is refunded automatically to the card it came from.
Text messages: we send appointment reminders, payment links, and receipts by SMS only if you have opted in (by ticking the box on the booking form or telling us in the studio). Message and data rates may apply. Reply STOP at any time to opt out, or START to opt back in.
Changing your appointment: every confirmation and reminder contains a private link to your booking, where you can see the details, move it, or cancel it under the notice period above.
Reviews and submissions
Reviews you submit through the site are moderated before they appear, and we may choose not to publish a review. Please do not submit content that is false, misleading, unlawful, infringing, or offensive. By submitting a review, you give us permission to display it, in whole or in part, on our site.
Intellectual property
The text, images, designs, and branding on this site belong to Zabota Nails unless stated otherwise, and may not be copied or reused without our written permission.
Limitation of liability
To the fullest extent permitted by law, Zabota Nails will not be liable for indirect, incidental, special, or consequential damages arising out of the service or your use of the site. Our total liability for any claim relating to a service is limited to the amount you actually paid for that service. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law — for example, liability for personal injury caused by our negligence, or for gross negligence, fraud, or willful misconduct.
Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. If a dispute arises, we ask that you first contact us so we can try to resolve it directly. Any dispute that cannot be resolved that way will be handled by the state or federal courts located in New York County (Manhattan), New York, and you agree to that venue.
Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they were last changed. Continuing to use the site or book a service after an update means you accept the revised Terms.
